Bondholders hire bounty hunters to pursue defendants and return them to authorities. Bounty hunters get a percentage of the bond amount if they manage to apprehend and return the accused, but they are not paid until they are unsuccessful.
There are a few laws that govern the qualification for the bounty hunter. The basic requirements at the state level include a clean criminal record, a minimum age of 18, registration with the police in their area and submission of a reference.
The federal government and most states enact laws limiting the activities of bounty hunters. If a person is injured by a bounty hunter, they may be entitled to personal injury against the bounty hunter and the company that hired them. Motivated to claim their fees, bounty hunters can cause injury to the accused or other people who use violence. Victims can sue the bounty hunters for their injuries, or the company can be held liable.
If the claim falls within the scope of personal injury law, the court may award damages. In addition to the pain and suffering suffered, the victim can also be compensated for medical costs related to his injuries. A lawsuit against the government or another entity for damage caused by bounty hunters can also be successful.
The courts have ruled that the government is not responsible for the actions of bounty hunters employed by private bail companies. Its aim is to prevent the bail society from losing its money and to help the prosecution and the court to ensure justice.
Unlike civil-rights lawsuits against police officers who cause harm through excessive use of force, these bounty hunters operate under state authority. In other words, the government is beholden to injured bounty hunters.
If you have been arrested for a crime, you may be released from custody while your trial is pending by depositing a bail. Bail is the amount of money that must be paid to the court and is intended to give the defendants an incentive to appear if necessary. Many defendants do not pay the full bail set by the judge, so they have to buy bonds from bail companies. You pay a non-refundable premium to a deposit intermediary and in return they deposit the full deposit amount with the court.
The premium is usually 10 percent of the deposit. By depositing the bail, the bail intermediary guarantees that the accused appears in court and the court agrees to release the accused from custody. The agent assumes the risk of the accused disappearing. If the agent is right and on track, a suspect who does not appear will be taken into custody before the bond expires. If a defendant does not appear, a bail company loses the full amount of the bond.
