For many people who want to leave prison without waiting a day or more for a judge, most prisons have a standard bail plan that sets bail amounts for common crimes. After his arrest, the detainee must pay the amount set by the bail. A judge is responsible for setting bail.

If a suspect wants to post bail but cannot afford the amount required under the bail plan, he or she can ask the judge for a lower bail. Depending on the state procedure, this could lead to a special bail hearing in which the suspect appears in court for the first time, known as an arraignment.

In recent years, courts have begun using mathematical methods to make early release decisions. Some jurisdictions select information about whether a suspect should participate in a program, and the results and recommendations come from there.

The bail algorithm takes into account factors such as age and criminal record and is designed to assess the risk of the accused committing a crime or not appearing in court.
