The Eighth Amendment to the US Constitution prohibits excessive bail, but not all federal courts are required to allow bail. A judge determines the bail amount based on factors such as the seriousness of the alleged offence, the likelihood that the accused will commit further crimes after his or her release and the likelihood that he or she will escape court jurisdiction. The judge sets bail at an unreasonable amount and refuses bail. If a person is in police custody and charged with the alleged crime, they may be able to leave prison by posting bail or obtaining bail.
