The most common method of depositing bail is to get a bail from a licensed bail bondholder to bail someone out for tens of thousands of dollars or more. The premium paid to the license is not refundable. You pay the bondholder 10% of the bond amount (if the defendant’s bail is set at $50,000), or you can buy a secure bond for $5,000. After payment of the 10% deposit, the bondholder must transfer the full amount to the court in order to secure the release of the accused. They must provide collateral for the bond or deposit, which can be substantial.

If you do not appear in court, the court will lose your deposit and the bond company may try to sell your collateral. Like real estate, personal property can disappear. It is rare for personal property to have considerable value, but it can be valuable, such as a painting or a collection of rare items. Most bail deposits are made by other defendants.

If the defendant flees the jurisdiction or fails to appear by the next date, the bond company will try to find him. If the defendant cannot be located, the company will look for you for payment. When you sign a bond with a bond company, you have certain obligations to you.

This applies regardless of whether you have to pay a deposit or not. If your underlying charge is a felony, you risk being charged with a felony for failing to appear. In this case, the court will issue an arrest warrant against you. However, if your underlying allegations are misdemeanours, your failure to appear will be misdemeanours.
