When someone is arrested, when do they see a judge?

• You have up to 72 hours before the court is required to present the charges/accusations against you. This is called an arrangement and is usually done within 48 hours. Some counties set arraignment for the next morning. It depends on availability of the court. This timeline does not include weekends or holidays. For example, if you are taken into custody on a Friday, it may be until Wednesday before you are arraigned.

Prison can be scary, but on bail you can leave prison while you await your hearing in the comfort of your own home, surrounded by your family. If you or someone you know has been arrested and you are curious about the bail process, take a look at what you can and can’t do while on bail.

If you need to travel outside the country, you must first obtain written permission from the court, and depending on the case and amount of the deposit, your deposit agent may reserve the right to restrict travel outside the state. Generally, if you are free on bail, you can travel outside the state with the written consent of the bail agent and the court. If you are on holiday or planning a hearing, you must grant a special permit. International travel is never allowed.

This is one of the many reasons why international travel is forbidden on bail. Even if you do not plan to leave, the mere fact that you are in another country may mean that you are late for your hearing if your plane is cancelled or you are stopped at customs. In most cases, the court does not allow bail.

If you have a job, keep going to work. As an added benefit, focusing on the job reduces the risk of minor crimes or activities that could result in your bail being annulled. If you stop going to work or remain in detention after you have paid a bail or have been released, you have less money for your defence and you could end up being released from your job. However, if you continue to go to work and appear in court, your community connections are less likely to be disrupted.

In many cases, if you are released on bail, you must meet certain conditions. By finding a job, keeping it close to your court dates and appearing in court, you are trying to take control of your daily life so that you can be a productive citizen in your community. This shows that you are setting a positive life pattern for yourself that can be communicated to the judge and your defence counsel on your behalf. If you don’t have a job, start looking.

The exact bail conditions will depend on the crime, your community, your criminal past and mental state. For example, if you have been arrested for drink driving, you may be subject to multiple bail conditions while awaiting trial. This includes avoiding alcohol, attending AA meetings, attending DUI and traffic school, and not going to bars or other places where alcohol is served. In the example above, you were hit by your car at the time of the DUI incident and have had a history of alcohol offences in your past, so you will be bound by stricter conditions.

Bail is the process that allows you to return to the house as long as you attend all hearings and court hearings related to the crime for which you are charged. If you do this and are found guilty, your bail is met. The deposit intermediary is relieved and the collateral for posting the deposit is returned.

If you use your own money as collateral and fail to appear at your hearing, you lose it to the bail agent and the court. The court issues an arrest warrant against you and sends you to prison. If you do not show up for a hearing after the case has been issued and you deposit bail, you can find the bail agent or an enforcement officer in your door to place you in jail, but the agent will not be instructed to pay the full amount of bail to the court, and the collateral you have deposited will not be lost to pay your bail and you will be forced to face your charges before a judge.

The bail lets you wait at home for your hearing so that you can continue to work and live your life.
