After your arrest, the officer will inform you of your legal rights. This means you can choose not to answer officers “questions or hire a lawyer. Lawyers encourage you to take this information seriously, as even the smallest details can weigh you down in court.
If you are arrested, you will be handcuffed and taken to the local police station for initial treatment. At the station, you will be questioned by police officers about personal data. This includes your name, address, date of birth and social security number. After taking your fingerprints, you will be taken to a central booking office where they will be processed for arrest or a court appearance.
As soon as the police officer starts asking questions that could implicate you in a crime, the interrogation begins. The request for your personal information is not considered an interrogation. The Miranda warning comes before you are interrogated or questioned.
Police officers are not allowed to use physical or psychological intimidation to get you to testify. Any information you provide to them is admissible after receiving a proper Miranda warning in court.
If you are charged with a crime, you must appear before a judge for a bail hearing. At that hearing, the judge will decide whether to save you or whether to wait behind bars until your trial begins.
Deposit is a fixed amount that must be paid before you can be released from prison. After the judge sets your bail, you must pay the full amount in advance or contact a bail company such as Delta Bail Bonds. If you do not have the money to make a deposit yourself, you can pay a bondholder up to 10% of the deposit as collateral to get you out of jail. By paying a bail, you agree to appear at your court date and follow the directions of the judge.
Prosecutors and defense attorneys negotiate plea deals. A judge views pleas as contracts between the two sides. Once a plea is reached, it will be submitted to the judge for approval. In federal court, the judge can approve or reject a plea or deal.
A trial is a structured process in which a jury hears testimony, reviews the evidence and reaches a verdict. Jurors must decide whether the defendant is innocent or guilty. The judge may also accept or reject a proposed plea.
During the trial, the prosecutor used witnesses and evidence to prove to the jury the guilt of the accused. The accused’s lawyer tries to prove the accused’s innocence by calling witnesses and passing on evidence. During the trial, a judge decides what evidence the lawyer will present to the jury. When the jury reaches a verdict, they notify the judge, the lawyer and the defendant in court.
