How Bail Works
If you have never had to bail someone out of jail, you might not know what a bail bond is and how the bail process works. Keep reading for the basic information about the bail bonds, and please call us @ (315) 681-6332 if you need more information.
What is Bail?
Bail is some form of property given to court to encourage the release of a defendant from jail. This ensures that the defendant returns to court for trial or they will forfeit the bail.
What is a Bail Bond?
If the defendant does not have the money or the assets to pay the full amount they can use the services of a bail bondsman. Cost of bail typically ranges from 8% to 15% of the full bail amount but can vary from state to state.
The amount for a bail up to $3,000 is 10% of the bail amount. After that, up until $10,000 you’re only paying 8% of the bail amount. After $10,000 the percentage goes down to 6%. For example, a $10,000 bail is $860 while a $20,000 bail is only $1,460.
This fee goes to the bail agent, who then provides the Bail Bond. The bond acts as insurance that the defendant will show up for all court dates. If the defendant does not show for court, the agent then becomes responsible for the full bond amount.
What is collateral?
Collateral is used to cover the remaining amount of the required bail as extra assurance that the defendant will present for the required court dates. Collateral can come in the form of property (homes, cars, etc.) investment accounts, or other items of value. Collateral will be returned once the Bail Bond has been exonerated and the defendant has fulfilled all obligations. If the defendant fails to appear or meet all legal obligations until the case is resolved, the collateral can be sold to cover the bail amount.
At Bail Network Bail Bonds, our goal is to help people in need. That’s why in today’s blog we’re happy to discuss a few things you shouldn’t do when you’re free on bail. Some of these things may seem obvious, but having a memory is never a bad idea.
We have set ourselves the task of being as helpful as possible at every step of the way. We know that we need a helping hand in difficult times. And that is exactly what we can offer. We cover many areas, so don’t hesitate to call our team of experts when your loved one comes out of prison.
One of the absolutely worst things a person can do when released on bail is try to run away. We’ve seen what happens when people skip bail, and you can trust us when we say it never is in your best interest. At the end of the day, running away from your problems will only make matters worse, and you will end up with more hot water than you ever were. Those who run away will only find more trouble.
Chances are you’ll end up in a worse place than you started. For starters, if you are not granted bail when you are arrested, this could be the start of your suffering. The judge does not want to pay bail, and if someone makes a bad decision, you may end up having to attend two court dates, which will only double your problems. There are circumstances in which you could be released on bail before you are even arrested.
If it is a friend, family member or co-worker who offers help, do not hesitate to call them for their kindness. Such offers should be taken seriously and appreciated. The truth is that people care about you. This is especially true when dealing with police officers, lawyers and your bail officer. There are a number of people out there who are trying to help you and keep things on track.
Take every opportunity to let them help because it’s a win-win situation for both of you. If you need to save yourself or a loved one, they will be there to help. If the situation gets out of hand, they will help you in your distress. It really is that simple.
Contact us today to get started and be sure you are in good hands. We always look forward to hearing from you.
