That’s how a bail hearing works. A bail hearing is your first court date after your arrest. Bail is a function to ensure your presence at future court hearings.

You have the right to have a lawyer present on your behalf. A lawyer is considered a defender. The judge submits the hearing to the prosecutor.

For minor crimes, the bail may be in the form of a written undertaking to appear in the future, or in the form of a bail if the conditions for your release are violated. The prosecutor will make a recommendation to the judge regarding your bail. The judge will take many factors into account when determining your bail. He or she will decide the type and amount of bail at his or her discretion and both sides will make their recommendations. You and your lawyer will make recommendations for your bail amount.

This type of deposit is called a signature bond. In setting your bail the judge asks you questions about a variety of aspects of your life and the crime you are accused of. You may have to pay a deposit in cash or some form in court before you are released. This is known as a cash bond.

If the alleged crime is a misdemeanor, the usual solution is to sign a low-value cash bond. If you are detained, the jurisdiction that issued the outstanding arrest warrant must respond. An outstanding arrest warrant for an earlier crime can result in your release being delayed. This is because the warrant was issued before your current arrest to deal with a current matter. An arrest warrant for failure to appear at your bond hearing may be suspended for a short time so that the court can respond.

Your judge will want to know where you will be and who will be with you for the duration of your case. You can rely on these people when it comes to avoiding further problems with the law. For example, families with a criminal record may be less able to help you. Allegations of violence, drug offences or other threats to the community should be carefully examined and never released against a signature.

You may be asked about your previous work history. You should be prepared to tell the judge where you worked, when you were employed and the hours you worked. You may also be asked how long you have been unemployed. The answer is no, no matter how damaging the information may seem.

A lack of prior arrests can act as a mitigating factor in terms of the amount of your deposit. In more serious cases, the court may ask for your ownership of property, vehicles or other personal property. A home, vacant property or other personal property must be pledged to meet the deposit.

Substance abuse can affect judgment to the extent that a person ignores future court dates. A previous conviction for drug or alcohol use can result in a higher bail. If the judge has your records on his desk, he knows you are lying. If you lie, you can end up in prison until your next court date, with no hope of being released before that date.

Be prepared to meet all the conditions if the judge orders your bail to be reduced. If you have not paid a deposit, you can apply for a reduction of the amount.
