Cherise Fanno-Burdeen, CEO of the Pretrial Justice Initiative, says we are in the third generation of bail reform. In 1966, two years after the first conference, the Bail Reform Act extended the practice of release defendants on their own. The excitement around bail reform seems to be that it is a new movement, but you will see if you look back, that this is not the case. I was in office at the start of this third generation in 2011, when Attorney General Eric Holder spoke at a national symposium on criminal justice. He spoke out in favour of jurisdictions looking for alternatives to bail.

That was what we expected. We knew we were coming, but the struggle for what we were going to get was a bit hard to see at first.

The city had the highest incarceration rate of any major metropolis and received $3.5 million to support bail reform for its system. Some of that money has been used to develop predictive risk algorithms that help judges decide whether a person in custody poses a real threat to the community and should be released. The way these algorithms work is to comb through administrative records to determine the likelihood of a re-arrest of a defendant who does not appear in court. They were the key to saving reform in New Jersey, Kentucky, Arizona and dozens of counties across the country.

This may seem simple and foolproof, but focusing on the most detailed aspects of a person’s story leads to the same problem that we have now. A disproportionate number of low-income blacks are behind bars. In other words, because so many blacks are incarcerated in such high numbers each year, these algorithms are biased by the system they are trying to replace. The reason they do not work is that they are stored on a generation of records, and they are drawn from a flood of information that the US wants to reform.

It is possible to create a functioning, unbiased system without going back to the drawing board and scrapping everything at that point. It is also possible to develop a kind of bail reform that works, even if we have initially damaged the entire judicial system. A functioning backstop reform is possible and should be.
