If you are arrested, it can be unexpected and you may be confused about your legal rights. The following information describes the circumstances in which you were arrested, who you are, why you are arrested, how long you have been detained and your legal right to be arrested. It is important to be informed of your rights, to say no or to refuse consent while you are in police custody. The circumstances of an arrest can be anything. A police officer will witness that you have committed an offence and he or she will arrest you.

If you are arrested for a crime, a serious crime that carries a prison sentence, the officer does not have to be a witness to the crime, but he or she must have probable cause to believe that you have committed the crime. It is up to the court system, not the police, to determine whether the officers “faith is valid and whether you are guilty or innocent. At the time of the arrest warrant, you are still in custody, whether you are aware of it or not. A violation of a state law, city ordinance, or federal law that carries no penalty other than imprisonment. If the offence is a minor offence or an administrative offence in which case a fine is the only possible penalty (not imprisonment), the officer can not arrest you if you refuse to sign a citation or write your name or if you do not appear in court to pay a fine for a similar charge.

An arrest warrant is a legal document issued by a judge ordering police to arrest and take your identity into custody. An officer who arrests you does not need a warrant for your arrest, but he or she must show it to you and produce a copy within a reasonable period of time (typically 72 hours). In other circumstances, you may be arrested regardless of the severity of the crime, including in cases of domestic violence or in cases where your mental state causes you to self-harm. There is nothing better than being arrested without a warrant.

Cooperate with the police and wait until you speak to a lawyer to explain your side of the situation. Never argue or oppose the police, even if you believe they have no reason to arrest you. Arguing or resisting arrest may result in additional charges being brought against you, and these charges could increase the bail amount the judge assigns.

If you have an arrest warrant, you have the right to inspect it within a reasonable period (up to 72 hours). My right to be arrested. The officer who is arrested may ask you questions other than your name and address, but must tell you that you have the right to do otherwise. You have the right to be informed of the reasons for your arrest.

You have the right to read your Miranda Rights questions. There is also a right to remain silent. The right to waive your right to remain silent in the knowledge that you or your answers will be used against you.

The right to stop answering questions and consult with a lawyer at any time. The right to speak to a lawyer and answer questions without signing anything. To answer questions and ask for an interview with a lawyer. And the right to a court-appointed lawyer if you can’t afford a private one.

You can try to be cooperative in answering questions at the police station, which could make it difficult for your lawyer to fully defend you. Contact friends and family members to inform them of your arrest and charges. Your solicitor can provide identification procedures, such as a list of people who see you as a potential witness to a crime.

The police can handcuff you, search you for weapons, take you to prison and take photos and fingerprints. A reasonable bail or bail allows you to be released from prison if you are charged with a capital crime. Appear in court for a preliminary hearing or trial within a reasonable period of time after your arrest to determine whether you are guilty or innocent. The police can arrest you at any time.

The police can ask you to search your car, home or other places for belongings. The police or the court can issue a search warrant if you refuse to consent to a search. Use your right to a lawyer to discuss and agree to the situation. You will not be punished if you refuse to consent to the search.

If you are arrested, it is because the police believe that you have committed a crime and they have gathered evidence to support that belief. Don’t argue with the police if you feel you have done nothing wrong. Do nothing while you are in custody.

If you need help navigating after your arrest, contact us to arrange a free consultation today.
