It stated that a defendant on trial for a capital offence could be released on the basis of his personal recognition or personal connection. Judges could go a step further and choose less serious alternatives, such as restricting defendants’ travel or enforcing bail that would be repaid when they appear in court.

Finally, Congress passed the 1970 District of Columbia Court Reform and Criminal Procedure Act that allowed judges to consider potential dangers of defendants. With the adoption of the Bail Reform Act of 1984, the justice system has made additional improvements to provide greater security for the community. A big mistake with the Bail Reform Act was that freed defendants committed more crimes while on bail.
